Welcome to Carmen Kirstein. These Terms & Conditions apply to your use of our website and to purchases made through our online store.

By using our website or placing an order with us, you agree to these Terms & Conditions. Please read them carefully before making a purchase.

About Us

Carmen Kirstein is a New Zealand business offering luxury sleepwear, loungewear, clothing, accessories and gifts.

Many of our garments are made in New Zealand in small batches or made to order. We work with carefully selected fabrics sourced from New Zealand and around the world.

Throughout these Terms & Conditions, “we”, “us” and “our” refer to Carmen Kirstein.

Products and Availability

We make every effort to accurately display and describe our products, including their colours, fabrics, features and sizing.

Please be aware that colours may appear slightly different depending on your device, screen settings and lighting conditions.

Due to the nature of fabric production, placement of prints and patterns may vary between individual garments. These variations are part of the individual character of the garment and are not considered faults.

Some of our fabrics and designs are available only in limited quantities. Once a fabric has sold out, we may not be able to produce additional garments in that colour or print.

We reserve the right to discontinue products or change product availability at any time.

Made-to-Order Garments

Many Carmen Kirstein garments are made after your order has been placed.

Our usual making time is approximately 1–5 business days before dispatch. During busy periods or for particular garments, production may take longer. If we expect a significant delay, we will contact you.

Made-to-order does not affect your rights under the New Zealand Consumer Guarantees Act 1993 or other applicable consumer law.

Pricing and Currency

Prices are displayed in the currency selected or shown on our website.

Shipping charges, where applicable, are calculated or displayed during checkout.

International customers are responsible for any customs duties, taxes, import fees or other charges imposed by the destination country. These charges are outside our control and are the responsibility of the customer.

We reserve the right to change our prices at any time. Any price change will not affect an order that has already been accepted and paid for.

If an obvious pricing or listing error occurs, we reserve the right to correct the error. If an order is affected, we will contact you as soon as reasonably possible.

Orders and Payment

When you place an order, you are responsible for ensuring that the information you provide is complete and accurate, including your name, email address, delivery address and product selections.

Payment must be successfully completed before we begin processing your order.

We reserve the right to decline or cancel an order where there is suspected fraud, unauthorised payment activity, an obvious pricing error, or where we are unable to supply the ordered product.

If we cancel an order after payment has been received, the amount paid for the cancelled item or order will be refunded.

Shipping and Delivery

Orders are sent to the delivery address provided at checkout. Please check your address carefully before completing your purchase.

Delivery timeframes are estimates only and may be affected by courier delays, customs processing, weather events or other circumstances outside our reasonable control.

Once your order has been dispatched, you will receive tracking information where tracking is available.

Returns, Exchanges and Faulty Products

Our returns and exchange process is explained in full on our Shipping & Returns page.

Nothing in these Terms & Conditions or our Returns Policy is intended to limit your rights under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other consumer protection law that applies to your purchase.

If an item is faulty, damaged, incorrectly supplied or does not meet the guarantees required by applicable consumer law, please contact us so we can assess the issue and provide an appropriate remedy.

Sizing

We provide sizing information to help you select the most suitable size.

Fit can vary depending on the design, fabric, cut and individual preference. Where relevant, additional fit guidance is included on the product page.

If you are unsure which size to choose, you are welcome to contact us before ordering.

Care Instructions

Care instructions are provided on garment labels and may also be included on individual product pages.

Customers are responsible for following the recommended care instructions. Damage caused by incorrect washing, drying, ironing, storage, handling or general misuse is not considered a manufacturing fault.

This does not affect any rights you may have under applicable consumer law.

Gift Cards

Gift cards are redeemable through the Carmen Kirstein online store and may be used toward eligible products available at the time of purchase.

Gift cards cannot be exchanged for cash except where required by law.

If the value of an order exceeds the available gift card balance, the remaining amount must be paid using another accepted payment method.

Any expiry date or additional conditions applying to a gift card will be clearly stated at the time of purchase or issue.

Discount Codes and Promotions

Discount codes and promotional offers are subject to the terms stated with the individual promotion.

Unless otherwise stated:

• only one discount code may be used per order;

• discount codes cannot be exchanged for cash;

• discount codes cannot be applied retrospectively to completed orders; and

• promotional offers may be changed, withdrawn or ended in accordance with the stated promotional terms and applicable law.

Intellectual Property

All content on this website, including photographs, product images, designs, artwork, graphics, logos, branding, written content and other original material, belongs to Carmen Kirstein or is used with permission.

You may not copy, reproduce, republish, distribute, commercially use or modify our website content without prior written permission.

Reviews and Customer Content

If you submit a product review, testimonial, photograph or other content to us, you confirm that the content is your own or that you have permission to share it.

Where you give us permission to use customer content for marketing or promotional purposes, we may display that content on our website, email marketing or social media.

We reserve the right not to publish or to remove content that is unlawful, abusive, misleading, fraudulent, discriminatory, defamatory, irrelevant or otherwise inappropriate.

These Terms & Conditions are governed by the laws of New Zealand.

Any dispute relating to these Terms & Conditions or purchases made through our website will be dealt with under New Zealand law, subject to any mandatory consumer rights or laws that may apply to customers in other jurisdictions.
